TrustRadius values your privacy. At our website, https://www.trustradius.com (the “Site”), we provide a business decisioning platform for businesses. In this Privacy Policy (“Policy”), we describe how we collect, use, and disclose information that we obtain from and about you in connection with our provision and marketing of our Site and our other services (collectively, the “Services”).

By visiting the Site, or using any of our Services, you acknowledge that your personal information (information about an identified or identifiable individual, like a name or email address) will be handled as described in this Policy. Your use of our Site or Services, and any dispute over privacy, is subject to this Policy and either our Terms and Conditions or, with respect to use by customer personnel under the customer's agreement with TrustRadius, that agreement, including the sections on limitations on damages and the resolution of disputes.

This Policy does not apply to our handling of the contact information that some customers provide us to send invitations to rate or review their software and services. We process that contact information solely to send the invitations on the behalf the customer that provides it to us. If you are invited to leave a rating or review, you may do so with or without creating a User Profile (as defined below). You also can leave a rating or review without being invited to do so.

The Information We Collect About You

We may collect information about you directly from you and from third parties.

The type of information that we collect about you varies based on your interaction with our Site and our Services.

  • Information We Collect Directly From You. We will collect information directly from you when you interact with certain portions of our Site, contact us, and use our Services.

    • Registration/Account Creation. Specifically, we require registration and/or account creation to access certain features of our Site (e.g., to post a review or make a comment). You may register with our Site by providing your email address. If, however, you seek to post a review or make a comment, then you must create an account by using your log in credentials for certain social networking sites (currently LinkedIn®). TrustRadius will store your LinkedIn® profile information as part of your TrustRadius profile, and we may disclose your profile information as described below under "How We Disclose Your Information". We may later offer additional means of registration or collect additional information as part of the account registration process.

      As part of your user profile, you may (but are not required) to submit additional information, including, for example, your picture, a "headline" describing you, name, country, city, state, industry, job type, department, expertise, or other professional or employment-related data.

    • Other Features. We will request additional information from you to access certain features. You may submit reviews of third parties' products/services on our Site, as described in more detail below. If you want to download a document, access a free trial or if you request to be contacted by a vendor, we will ask you for additional information, including but not limited to your phone number, your company, your title and other information pertinent to the action that you are taking on the Site.

  • Information in Ratings and Reviews . The ratings and reviews you provide to us could include any type of information. If you participate in a video interview (live or online), such as for a rating or a review, the footage will of course contain images and audio of you and the area around you. For example, if you give the video interview while wearing a nametag, the contents of the nametag may be visible in the video. We ask for various information in this context, including your name, work email address, company name, job title, industry, and information and opinions about the product you are reviewing.

  • Information We Collect Automatically. We may automatically collect the following information about your use of our Site or Services through cookies, web beacons, and other technologies: your browser type and operating system; web pages you view; links you click; your IP address; the length of time you visit our Site and or use our Services; the referring webpage that led you to our Site; and a unique code assigned to your browser or device. Please see the discussion below entitled “Cookies and Other Tracking Mechanisms” for additional Information.

  • Information that We Collect About You from Social Networking Sites. When you log into our Site using your social networking credentials, we will request access to your profile and your email address. If you seek to use other features of our Services, such as to invite your colleagues to join our Site, we will request additional permissions from you. We will request your permission before accessing the information in your social networking site. If you decline to grant us permission, we may be unable to perform the service that you request.

    We store some information that we receive from social networking sites with other information that we collect from you with your approval. The social networking site controls the information that it collects from you. For information about how the social networking site may use and disclose your information, including any information you make public, please consult its privacy policy. We have no control over how any third party site uses or discloses the personal information it collects about you.

  • Information We Collect From Other Third Parties. We also may collect personal information about you from other third parties, including internet service providers; operating systems and platforms; data brokers; data analytics providers, social media networks such as LinkedIn, and public records.

Your Reviews

There are two ways you can post a review: (1) entering it directly into our Site, and (2) in special cases, giving us the reivew through another means (such as an in-person video interview) and authorizing us to post it for you. We refer to both of these activities as "posting. " Reviews have two components:

  • Content of the review: Every posted review will contain the review contents. For example, if you post a video review, it will include the video of the interview unless you asked us to publish only the transcript of the video instead of the video itself. Depending on what you say in the review, and depending on whether you post a video review, you or the company may be identifiable from the contents of the review, regardless of the choice you make regarding attribution of the review, as described below.

  • Attribution of the review: In addition to the review contents, we will also display some information about you as the review author:

    • By default, we will add a link in the review to your full profile and list your name, title, company name (together, your "Profile Information ").

    • However, we will not add those data points if you specify that the review should be "Anonymous ". When you make a review by "Anonymous." we instead add the size and industry of your company, as well as your job type and department (your "Professional Profile ) (if you chose to provide us with this information or other details that let us determine it, such as your title and company name). If the review is a video recording, making the review "Anonymous" does not edit or remove the video recording from the Site or Services, and other users will continue to see you, hear your voice, and see or hear any information about you that appears in the recording, including any nametag you may have been wearing. If you want remove the posting of a review entirely, or switch a video review to be only a transcript, you have the option to do that.

You may update your choice about whether a review is "Anonymous" at any time, but if you originally published it as not "Anonymous," third parties and other users of the Site already may have had access to your review in association with your name, and there might be cached copies and static content of the Site in those third parties possession, including in publicly available third-party services, such as search engines. As such, complete copies of your review, linked to your name, may be viewable elsewhere on the Internet even if you change your review to "Anonymous" when displaying it on our Site. (The same thing is true for other changes you may make to a review, as described in the “Access to Your Personal Information” section below.) Please note that you will need to exercise your choice for each review that you post.

How We Use Your Information

We use your information, including your personal information (collectively “information”) for the following purposes:

  • To provide our Services.

  • To communicate with you about your use of our Services, to respond to your inquiries, to fulfill your orders, and for other customer service purposes, which may include communicating with you via email.

  • To tailor the content and information that we may send or display to you, personalized help and instructions, and to otherwise personalize your experiences while using the Site or our Services.

  • For customer loyalty programs.

  • For marketing and promotional purposes to send you news, newsletters, or marketing materials about TrustRadius products or services that may interest you, or special offers (such as incentives for reviewing products or services you've used) from us or from companies listed on our Site. We also may use the information that we learn about you to assist us in advertising our Services in various forums, including on third party websites, on social media sites, among other means. You may opt-out of TrustRadius marketing emails at any time in your communication preferences.

  • To better understand how users access and use our Site and Services, both on an aggregated and individualized basis, to improve our Site and Services and respond to user desires and preferences, and for other research and analytical purposes.

  • To address legal requirements.

  • To investigate, prevent, or take action regarding suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms of Service, or other illegal activities, or to otherwise establish, exercise, or defend our legal rights.

How We Disclose Your Information

We may disclose your information as follows:

  • TrustRadius Users. Registered users may control certain privacy settings on our Site. As a default, your full profile, including your name, title, company name (your "Profile Information") will be available to all visitors to our Site, including non-registered users. You may change this setting to provide more or less visibility by logging into your account and choosing your preferred privacy setting. If you change your privacy settings to hide your name, title, and company name, all visitors to our Site will still be able to see the size and industry of your company and your job type and department (your "Professional Profile ")(if you chose to provide us with this information) Separately, you also adjust whether your Profile information or Professional Profile is displayed in connection with ratings and reviews you post.

  • Your Social Networking Contacts. If you grant the requested permissions, we will have access to your contacts at the various social networking sites, and, with your express consent, we may invite your contacts to join our Site and our Services.

  • Vendors and Service Providers. We may disclose the information we collect from you to third party vendors, service providers, contractors or agents who perform functions for us or our customers, such as data storage and hosting providers, email service providers, analytics providers, marketing and advertising providers, network and system management providers, communications tools, IT support providers, CRM providers, incentive providers, and accounting services. We may also allow them to collect information from you and your browser directly.

  • Companies Listed on the TrustRadius Site. We may disclose your review(s) to the companies or providers of the products/services that you reviewed or to other companies listed on our site. Some of the listed companies are customers of our Services. The scope of information that we will disclose depends on the privacy settings on your review(s) at the time the disclosure happens.

    If you chose for your review to be “Anonymous,” we will disclose the content of your review and your Professional Profile.

    If you choose for your review to be "Anonymous,: then we will disclose the content of your review and your Profile Information in accordance with the privacy settings on each of your reviews, which you can control at www.trustradius.com/profile, or by contacting support@trustradius.com.

    Updates to your privacy settings may take up to 24 hours to be fully implemented, but they will not have retroactive effect. For example, if we disclose a review to the company whose product you reviewed, we will include your name if you have not marked the review as “Anonymous”. If you later change the review to "Anonymous", this will not affect any disclosures of the review we may have made prior to it being "Anonymous" or cause deletion of your name from that company's record of your review, as they received it prior to that change. The same is true for other updates that you make to a review after we first disclose it to the company: although we may provide them with the updated content, this does not cause deletion of the original version from their records.

    These entities may use your Profile Information to market their products and services to you, as well as to post your review on their website or otherwise use the content in your review, subject to the privacy settings on each of your reviews.

    The providers of the products/services listed on our Site, and their partners, may use the technology described in the "Cookies and Other Tracking Mechanisms" section of our Privacy Policy on their pages of our Site to collect information for analytics and advertising purposes. Controls for this data collection are described in that section of our Privacy Policy and are different from the email preference settings and the review privacy settings described above.

We also may disclose your information in the following circumstances:

  • Business Transfers. If we are acquired by or merged with another company, if substantially all of our assets are transferred to another company, or as part of a bankruptcy proceeding, or in anticipation of any such activities, we may transfer the information we have about you to the other company.

  • In Response to Legal Process. We also may disclose information in order to comply with the law, a judicial proceeding, court order, or other legal process, such as in response to an appropriate court order or subpoena.

  • To Protect Us and Others. We also may disclose information where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms of Service or this Policy, or as evidence in litigation in which we are involved.

  • Aggregate and De-Identified Information. We may disclose appropriately aggregated or de-identified information with third parties for any purpose, including for marketing, advertising, or research.

Cookies and Other Tracking Mechanisms

We and our third party vendors and service providers, as well as some of the companies whose products/services are listed on our Site, and their vendors and service providers, use cookies, web beacons, pixel tags, scripts and other technologies to track information about your use of our Site or Services. We combine this information with other personal information we collect about you to develop a more complete understanding of you, to improve your experience on our Site, to assist us and our customers with advertising and marketing, and for other purposes described in this Policy.

  • Cookies. Cookies are files that are stored on your device through your web browser.

  • Web Beacons, Pixel Tags, and Scripts. These technologies, which we may place on our Site and in our emails, operate in your browser or in your email program and can run operations on your device (such as reading and writing cookies) and can send information from your device to us or third parties. They can help us track e-mail response rates, measure or improve the success of our marketing campaigns, identify when our e-mails are viewed and track whether our e-mails are forwarded; and provide information about your device, your actions on the device, and your interactions with your Site or Services.

  • Disabling Cookies. Our Site will not function properly without certain cookies enabled. If you disable such cookies, the Site may not function as intended. If you wish, you can logoff from the Site once you are done and then delete any cookies that remain. However, we recommend using the Cookie Settings link in the footer to set your cookie preferences. If you clear your cookies after doing that, or use a browser that automatically clears cookies, you’ll need to set your preferences again.

Certain cookies and similar technologies allow us or third parties to engage in analytics or advertising services, as described in more detail below.

Analytics

We and our customers use certain automated analytics tools (including cookies and other technologies operated by third parties) to track and evaluate usage of our Site and Services. We use these tools to help us improve our Site and Services, such as by improving our performance and your user experience, and to understand interactions with your Site and Services. We may combine this information with other information we collect from our users, and we may provide the third-party analytics providers with information, including personal information, about you.

To opt out of Google Analytics in a particular browser, you may install a Google Analytics Opt-out Browser Add-on in that browser (if it is compatible with that browser). We recommend using the Cookie Settings link in our footer to adjust third-party cookie analytics cookies generally. If you clear your cookies after doing that, or use a browser that automatically clears cookies, you’ll need to set your preferences again.

Third-Party Ad Networks

We and our customers may use third parties such as ad networks to serve advertisements on our Site and on third-party websites or other media (e.g., social networking platforms). Such third parties may collect data on our Site and Services using cookies and other technologies. These activities enable us and these third parties to target advertisements to you for products and services in which you might be interested. Third-party ad network providers, advertisers, sponsors and/or traffic measurement services may use these technologies to measure the effectiveness of their ads and to personalize advertising content to you. These third-party cookies and other technologies are governed by each third party's specific privacy policy, not this one. We may provide these third-party advertisers with information, including personal information, about you.

We recommend using the Cookie Settings link in the footer of our Site to adjust your preferences regarding the use of cookies for these purposes. In addition, you may go to the Digital Advertising Alliance ("DAA") Consumer Choice Page for information about opting out of interest-based advertising and their choices regarding having information used by companies participating in the DAA. You may also go to the Network Advertising Initiative ("NAI") Consumer Opt-Out Page for information about opting out of interest-based advertising and their choices regarding having information used by NAI members.

Opting out from one or more companies listed on the DAA Consumer Choice Page or the NAI Consumer Opt-Out Page will opt you out from those companies' delivery of interest-based content or ads to you on the browser that you use to perform the opt-out, but it does not mean you will no longer receive any advertising through our Site or on other websites. You may continue to receive advertisements, for example, based on the particular website that you are viewing (i.e., contextually based ads). Also, if your browsers are configured to reject cookies when you opt out on the DAA or NAI websites, or to clear cookies automatically after some time, your opt-out may not be effective. Additional information is available on those sites.

Note that if you replace, change, upgrade or reset your browser or device, or delete your cookies, or use a browser that automatically clears cookies, you may need to use these opt-out tools again.

Our Site and Services may contain links to third-party websites. For example, occasionally, at our discretion, we may include or offer third party products or services on our Site. These third parties have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of those linked sites, including their information practices.

User Generated Content

Our Site is a forum for users to share their experience with various products and services. To this end, we invite registered users to post reviews on our Site. We may invite individuals who are not users to participate in reviews that such individuals may authorize us to post on the Site or Services. Please note, however, that if you post reviews to our Site or authorize us to post your reviews, then all of the information that you post in the review will be attributed to, depending on your privacy settings, either your Profile Information or your Professional Profile (or to you, if you do not have an account and authorize us to publish a review on a non-"Anonymous" basis). Unless you adjust your privacy settings, your full identity and Profile Information will be publicly visible from our Site. Please also note your Professional Profile will be available to all visitors to our Site. If you post your own content on our Site or Services or authorize us to do so, this information may become public, and we are not responsible if other users use such information in a manner inconsistent with this Policy, the law, or your personal privacy. You are responsible for the accuracy of any information contained in your postings or that you authorize us to publish.

Security and Retention of Your Personal Information

We have implemented some precautions to protect the information we collect from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please be aware that despite our efforts, no data security measures can guarantee 100% security.

You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, and keeping your log-in and password private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.

We may retain your information until we determine that retention no longer is necessary to fulfill the purpose for which it was collected and retained, and as required by applicable law. Retention periods may vary depending on the type of information and the context and purpose of its collection and use.

Children

The TrustRadius Site is not directed to children under 16 years old, and we do not market to or knowingly collect any personal information from a child under the age of 16.

Updates to Profile Information

You may log into your account at any time to update your profile information. Please note that copies of information that you have updated, modified or deleted may remain viewable in their original form in cached and archived pages of the Site for a period of time and may have been disclosed to users or other third parties prior to your update, modification, or deletion of the information. Certain third parties (such as search engines that visit our web site) might continue to publish the original versions of the information. We are unable to update, modify, or delete information that was previously disclosed to a third party or that has otherwise been cached or archived by a third party. The same thing is true for changes you make to the privacy settings for a review, as described in the “Your Reviews” section above.

Your Personal Information Rights

We may send periodic promotional emails to you, subject to applicable law and any preferences you have expressed to us. You may opt out of such communications by following the opt-out instructions contained in the e-mail. Please note that it may take up to 10 business days for us to process opt-out requests. If you opt out of receiving emails about recommendations or other information we think may interest you, we may still send you e-mails about your account or any Services you have requested or received from us.

In addition, residents of the European Economic Area, the UK and other jurisdictions have certain legal rights regarding their personal information, including:

  • Obtain confirmation of whether we hold personal information about them, and to receive information about its processing;
  • Obtain a copy of the personal information, and in some cases, receive it in a structured, commonly used and machine-readable format, or have it transmitted to a third party in such form;
  • Update, correct or delete certain information;
  • Object to the processing of certain information (for example, the right to opt out from our processing of personal information for direct marketing purposes); and
  • Withdraw consent previously provided for the processing of the information (which will not impact the lawfulness of any processing that took place prior to the effective date of the withdrawal).

Every individual also has a right to lodge a complaint with the relevant supervisory authority. Other than that right, and for many individuals the direct marketing opt-out right, all of the rights described in this section are subject to important limitations under applicable law. To exercise any of those rights, individuals should contact us as described at the end of this Privacy Policy.

For Nevada Residents Only: Under a Nevada privacy law, certain Nevada residents may opt out of the "sale" (as defined in that law) of certain categories of information about them for monetary consideration to a person for that person to license or sell such information to additional persons. As of the effective date of this Privacy Policy, we do not engage in such "sales" of information covered by that law. However, if you are a qualifying Nevada resident, you may submit a request to opt out of any future "sales" by us under that Nevada law by writing to us as described at the end of this Privacy Policy. We reserve the right take reasonable steps to verify your identity and the authenticity of the request. Once verified, we will maintain your request in the event our practices change.

For California Residents Only: Rights under California law are described in the following section.

Special Notice to California Residents

This section applies only to "personal information" about California residents, as that term is defined in the amended California Consumer Privacy Act ("CCPA"), and it supplements the information in the rest of our Privacy Policy. Data about individuals who are not residents of California may be handled differently and is not subject to the same California rights described below.

Collection, use, and disclosure of California personal information

During the 12 months leading up to the effective date of this Privacy Policy, TrustRadius collected all of the information described in the Information We Collect About You section of our Privacy Policy from and about California residents.

"Sales and "sharing"

As part of a few of our uses and disclosures of personal information, during the 12 months leading up to the effective date of this Privacy Policy, we may have “sold” and “shared” (as those terms are narrowly defined under the CCPA) California residents’ internet or electronic network activity (like an IP address and record of a browser’s visit to our Site) and identifiers (like names and email addresses) to marketing and advertising services to assist with such activities, and to our customers, to assist with their marketing and advertising. This practice continues today. We do not “sell” or “share” personal information (as those terms are defined under the CCPA) if we have actual knowledge that the consumer is less than 16 years of age.

To exercise your CCPA right opt out of what the CCPA calls “sales” or “sharing” of personal information, please follow the instructions on our Your Privacy Choices form.

Your browser may also offer a way to activate the Global Privacy Control signal (“GPC”). Our Site treats qualifying browsers for which the user has activated the GPC signal as having opted out of what CCPA calls a “sale” of any California personal information that is collected on the Site from that browser using cookies and similar technology. You can override that treatment for a GPC-enabled browser by using the cookie controls available from the Site’s footer to opt into particular categories of cookies from that browser, or by clearing your cookies or using a browser that automatically clears cookies. In that case, “sales” via cookies and similar technology in those categories may resume on that browser.

California privacy rights

If you are a California resident, California law may permit you to request that we:

  • Provide you the categories of personal information we have collected or disclosed about you in the last twelve months; the categories of sources of such information; the business or commercial purpose for collecting or (if applicable) selling your personal information; and the categories of third parties to which we disclosed personal information, and more specific information about what categories of personal information were “sold,” “shared,” or disclosed to particular categories of third parties, similar to the detail in the sections of this Privacy Policy.
  • Provide access to and/a copy of certain information we hold about you.
  • Delete certain information we have about you.
  • Correct certain information we have about you.

Certain information is exempt from such requests under applicable law. You also may have the right to receive information about the financial incentives that we offer to you (if any). You also have certain rights under the CCPA not to receive "discriminatory treatment" (within the meaning of the CCPA) for the exercise of the privacy rights conferred by the CCPA.

To request to exercise those CCPA rights, please email us at privacy@trustradius.com. In order to verify your identity, we will follow up with you via email before processing your request, and if you are an accountholder, we may require you to login to your account as part of the verification process. For security and legal reasons, TrustRadius may not accept requests that require us to access third-party websites or services.

You are also permitted to designate an authorized agent to submit certain requests on your behalf. In order for an authorized agent to be verified, you must provide the authorized agent with signed, written permission to make such requests or a power of attorney. We have no obligation to honor requests from purported agents if we lack sufficient confidence that this has occurred and that they are actually submitting the request on your behalf. We may require you to verify your identity directly with us before processing an agent's request.

Although the CCPA also now confers certain rights to limit certain uses of what the CCPA calls “sensitive personal information,” we do not use that sort of information in a manner relevant to that opt-out right.

International Data Transfers and Privacy Shield

TrustRadius is headquartered in the United States. TrustRadius previously was a participant in the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework with respect to "Customer Lists" that TrustRadius received in the United States from the European Economic Area, the United Kingdom and Switzerland. A "Customer List" is a list of individuals' names, email addresses, and company names, which TrustRadius receives from its customer and uses to email those individuals, on behalf of the customer, to invite them to review that customer’s products/services on our Site. We recognize that the Court of Justice of the European Union ruled in July 2020 that a certification under the EU-U.S. Privacy Shield Framework no longer can serve as the basis by which entities subject to the GDPR export Personal Data to outside the UK and the European Economic Area. Following the invalidation of that Framework, TrustRadius let its membership lapse and is no longer a current participant. TrustRadius was a participant in the Framework between July 29, 2018 and August 5, 2022 (the "Certified Period"). As affected customers who relied only on our Privacy Shield certification transition to the European Commission-approved Standard Contractual Clauses, TrustRadius will continue to honor its obligation to comply with the Privacy Shield Principles with respect to such data received during the Certified Period. TrustRadius makes its own transfers of personal data, in many cases through the use of European Commission-approved Standard Contractual Clauses and other data protection contract language. To exercise any legal right to see copies of the data transfer mechanism documents that TrustRadius uses to transfer data, please contact us as described below.

During the Certified Period, TrustRadius certified to the U.S. Department of Commerce that TrustRadius adhered to the Privacy Shield Principles with respect to Customer Lists. If there is any conflict between the terms in this Privacy Policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern with respect to the Customer Lists we received pursuant to Privacy Shield during the Certified Period. For Customer Lists received on August 6, 2022 or later, this Privacy Policy will govern. To learn more about the Privacy Shield Framework, visit the U.S. Department of Commerce’s Privacy Shield site, and to view our Privacy Shield certification, please search for TrustRadius in the list of Privacy Shield participants at https://www.privacyshield.gov/list.

TrustRadius accepts responsibility under the Privacy Shield Principles for Customer Lists received during the Certified Period if an agent of TrustRadius to whom we have transferred personal information fails to process the personal information in a manner consistent with our Privacy Shield obligations, unless we are not responsible for the event giving rise to the damage.

TrustRadius is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission for the Customer Lists received during the Certified Period.
